In Board of Ottawa Township High School District 140, et al. v. United States Dept. of Education, et al., two Illinois public school districts and four special education students and their parents challenged portions of the No Child Left Behind Act, claiming they violated the IDEA.

General : 11th Circuit Awards Student Prospective Private School Placement as Compensation for IDEA Violations

In a recent ruling, the U.S. Court of Appeals for the Eleventh Circuit upheld a lower court’s award of prospective placement at a private school as a remedy for the district’s denial of FAPE to a student with disabilities.
